The Supreme Court has given President Trump extreme resistance. Trump has been facing defeat and most recently, he faced defeat during the birthright citizenship appeal. He also faced defeat during the tariff appeal last month.
The Supreme Court has been deciding what cases come to them and what ones can go to lower courts. John Sauer, the solicitor general, is also weeding out the appeals they think will lose and only bringing cases where they have a good chance of winning emergency relief to block lower court appeals.
The birthright appeal would end birthright citizenship for undocumented immigrants and foreigners on short term visas. “The 79-year-old president suggested on Truth Social that it’s “too bad” the Supreme Court didn’t “study” Mark Levin’s Fox News show, in which the host argued that the 14th Amendment was not intended to grant birthright citizenship to children of undocumented immigrants,” wrote Ewan Palmer on The Daily Beast. This fight has been turned down by multiple lower courts already.
Trump attended the birthright citizenship appeal on April 1st and reportedly stormed out during the appeal. He stormed out since most of the arguments were being shut down, making it sound like he’s losing the appeal. Eventually, he did.
During Trump’s rant at 1:00 am, he spoke about wishing the Justices would use their power for the good of the country. He also stated, “They failed miserably on Tariffs, needlessly costing the USA Hundreds of Billions of Dollars in potential rebates for the benefit haters and scammers. Stated the Dailybeast.” The Justices appointed by Trump are skeptical about whether he can take away the birthright citizenship.
On the other hand, many emergency appeals were being won by Trump’s lawyer. “Trump emerged victorious in all but a few of the roughly 30 emergency appeals,” writes John Gerstein from the Politico. Some believe they’re treating every rebuff of Trump’s policy as national emergencies.
The administration will lose some and win some, but Trump is maddened by the losses. However, sometimes the court picks what they appeal without input from Trump.
His reactions show that he’s feeling like he’s losing his grip on the court.
